1. Introduction
Using the shop.piera.ro website implies acceptance of these Terms and Conditions, including the annexes mentioned in the document, by any visitor/user/buyer.
This document (hereinafter referred to as the "Terms and Conditions") establishes the terms and conditions of use of the shop.piera.ro website and the conditions for purchasing products sold through this website. The documents referred to in the Terms and Conditions are an integral part thereof. By accepting the Terms and Conditions, Buyers/Users express their agreement with all documents mentioned therein as annexes.
Using the shop.piera.ro website (including visiting and purchasing products) implies acceptance of certain Terms and Conditions of Use, including the policies attached to them, obviously in the form of a legal contract between the visitor/User and PIERA, therefore, it is recommended to read the following paragraphs carefully.
Visiting or purchasing products from the shop.piera.ro website automatically implies acceptance of these Terms and Conditions. Also, using any other current or future services provided by PIERA implies acceptance of the same Terms and Conditions.
If you do not agree to the Terms and Conditions, please do not use this site.

2. Company. Definitions and terms
PIERA SRL .– is the company operating this site, a Romanian legal entity, organized and operating in accordance with the laws of Romania in the form of a limited liability company, headquartered in Cluj-Napoca, B-dul Muncii, No. 16, building 1, Cluj County, registered with the Cluj Trade Register under no. J12/2239/2002, Unique Registration Code RO15007686, account no. RO19BTRL01301202952616XX opened at Banca Transilvania Cluj, having the contact details above or which can be contacted via the contact form, hereinafter referred to as “PIERA”.
Seller – PIERA
Buyer – any natural person who places an Order online on this Site or by telephone, having the status of consumer according to the legislation in force.
User – any natural person registered on the Site, who, by completing the Account creation process, has agreed to the site-specific clauses in the Terms and Conditions section.
Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client/Buyer and the Buyer's history on the Site (Orders, tax invoices, Goods warranties, etc.).
website – the domain www.piera.ro and its subdomains.
Command – an electronic document as a form of communication between the Seller and the Buyer through which the Buyer/Client transmits to the Seller, through the Site, by completing the necessary technical steps, his intention to purchase Products from the Site under the conditions provided for in the Terms and Conditions.
Product(s) – any good sold by PIERA on this Site, requested by the Buyer/Client through the Order, to be delivered by the Seller to the Buyer/Client under the conditions provided for in the Terms and Conditions, as a result of the concluded Contract, on the territory of Romania.
Contract – represents the distance contract concluded between the Buyer and PIERA, in accordance with the Terms and Conditions accepted by the Buyer, without the simultaneous physical presence of the Seller and the Buyer.
Content – represents (1) all information on the Site that can be visited, viewed or otherwise accessed using an electronic device; (2) the content of any e-mail sent to Buyers by the Seller by electronic means and/or any other available means of communication; (3) any information communicated to the Buyer by any means by an employee/collaborator of the Seller, according to the contact information; (4) information related to the Products and/or the rates charged by the Seller in a certain period; (5) data relating to the Seller.
Review – a written evaluation by the owner of a product, an evaluation written based on personal experience and their ability to make qualitative comments and to say whether or not the product meets the specifications stated by the manufacturer.
Question – the address formula for Users/Buyers in order to obtain information about the products on that page.
Response – written information that is transmitted to the User/Buyer who asked a Question on the Site, on the page of a specific product. The answer represents an explanation provided by the Seller to a User/Buyer within a discussion.
Document – Terms and Conditions.
Newsletter – means of periodic, exclusively electronic information, namely electronic mail (e-mail, SMS) on the Products and/or promotions carried out by the Seller in a certain period, without any commitment from the Seller with reference to the information contained therein.
Details/Description – all specifications and/or descriptions of the Products as specified in their description.
3. General information
The Terms and Conditions shall apply to all sales of products made by PIERA, through its website shop.piera.ro. In the Terms and Conditions, the above terms shall have the meaning detailed in point 2.
In order to place a valid Order, Buyers/Users must be at least 18 years of age.
The images published on the site are consistent with reality, but sometimes the shades/colors of the Products may be slightly different in reality, due to your monitor settings or the photography execution process.
Shop.piera.ro Buyers/Users will always be informed whether a product is in stock or not and how long it will take to arrive. This information will be sent via email or phone after the Buyer/User places the order.
PIERA also reserves the right, at any time, to modify, suspend or cease the online marketing of the Products in part or in whole, temporarily or permanently. Orders validly confirmed by PIERA, prior to the modification, suspension or cessation operations ordered, will be executed by PIERA accordingly.
The images and information presented on the site may be modified by PIERA without prior or specific notice.
Products sold through shop.piera.ro will be accompanied by a tax invoice and receipt upon delivery. The online sale of Products takes place in a retail system, not a wholesale system.
By placing an Order on the Site, the Buyer agrees to the form of communication (telephone or email) through which the Seller conducts its operations.
PIERA's acceptance of the Order is considered completed when the Seller sends a confirmation to the Buyer via email and/or telephone, without the need for confirmation of receipt from the Buyer.
The Contract concluded between the Seller and the Buyer enters into force upon confirmation of the Order by the Seller, via e-mail and/or telephone. This document - Terms and Conditions - will form an integral part of the Contract together with the documents accompanying the delivery.
4. Ownership - Copyright
Using the shop.piera.ro Site (including visiting and purchasing products) implies acceptance of the Terms and Conditions, this acceptance representing a contract between the Buyer/User and PIERA, therefore, it is recommended to read the following paragraphs carefully.
Visiting or purchasing products from the shop.piera.ro Site automatically implies acceptance of the Terms and Conditions, together with their annexes. Also, using any other current or future services provided by PIERA implies acceptance of the corresponding Terms and Conditions.
The entire content of the shop.piera.ro Site is protected under copyright law and intellectual property rights laws. The use of any elements belonging to the shop.piera.ro site without the written consent of PIERA is punishable under the laws in force.
It is prohibited to modify the Website in whole or in part, reproduce the Website in whole or in part, copy, sell or exploit the Website in any other manner.
Visitors/Buyers/Users will not modify, copy, distribute, transmit, display, publish, reproduce, license, create derivative works from, transfer or sell any information or services obtained from or through this Site, nor will they acquire any right or license to use any of the information on the Site.
We inform you that PIERA is a registered trademark, in this regard any use of the trademark without the company's consent is punishable by law.
The content of this Site, including but not limited to logos, stylized representations, symbols, images, photographs, text content and the like, are the exclusive property of PIERA. It is not permitted to copy, distribute, publish, modify, supplement, use, display, include, link, transmit, remove signs, photographs, images, pieces of text, display, sell, etc., the content, data, information, photographs or other information on the Site.
Visitors/Buyers/Users are not permitted to use any automatic or manual device to monitor the materials available on the Site.
The above provisions do not affect the Buyer/User's right to print/list the contents of the Order or the Contract.
5. Confidentiality
Visitors/Buyers/Users are obliged to maintain the confidentiality of non-public information that they have become aware of when accessing and using the Site, as well as during communications sent during registration, authentication, placing and honoring Orders and other such aspects related to the use of the Site.
The Client's transmission of information or materials through this site, ideas, concepts, know-how, techniques, etc. gives us unrestricted and irrevocable access to them, the right to use, reproduce, display, modify, transmit and distribute these materials or information.
PIERA has a strict policy of respecting the confidentiality of the data of Buyers/Users of the shop.piera.ro Website and takes all steps to ensure the security and confidentiality of data hosted and transmitted through its computer system.
By accessing the Site and our products, PIERA processes your personal data necessary to fulfill the purposes for which this data was requested and collected. Regarding your rights as a data subject as guaranteed by Regulation 2016/679/EU on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, please access the Privacy Policy on the protection of personal data made available to you on the Site and the other measures implemented to guarantee your rights.
The processing of personal data of Buyers/Users is carried out in accordance with the Privacy Policy on the protection of personal data, which can be consulted in the Privacy Policy section, which is an integral part of the Terms and Conditions.
6. Registration as a User
Any person can register as a User on our Site by simply clicking on the Registration button available on the main page and completing the required steps for registration.
To register, you must enter your first name, last name, email address and a password. You are required to enter a valid email address, otherwise it will not be possible to continue the registration procedure on the Site.
You are fully responsible for keeping your password and any registration, login and account information secure. You are fully responsible for any orders and/or payments made using our Site from your Account.
7. Product and pricing information. Limitations
The information included on the Site is provided in good faith by PIERA.
The prices displayed on the shop.piera.ro Site are in LEI (RON) and include VAT according to the legal provisions in force at the time of marketing these products. The prices displayed are valid at the time of accessing the page where they are displayed, PIERA reserving the right to modify them at any time, without any prior notice or notification.
PIERA tries, within the Site, to provide a detailed description of its products, but does not guarantee that the description of the products or any other content of the Site shop.piera.ro is complete or completely free of errors. In the event of errors, PIERA will take the necessary measures to correct them, and if the error has affected an Order, the Buyer will be informed as soon as possible, offering the option of reconfirming the Order at the correct price or the possibility of immediately canceling it.
If the Buyer cannot be contacted before the Order is confirmed, PIERA reserves the right to consider the Order cancelled by informing the Buyer about this by email. If the Buyer has paid for the products from a cancelled Order, PIERA will refund the amount received from him within a maximum of 14 days from the date of cancellation of the Order.
By placing an Order on the shop.piera.ro Website, you irrevocably undertake to pay the value of the ordered products. In this regard, we inform you that, as part of the procedure for registering your orders, you will be redirected to the websites of our collaborators in order to collect the data necessary for payment.
PIERA also assumes no responsibility for damages relating to or in connection with: loss of data, lost profits, inability to use the data on this Site, changes made without prior notice to the data, prices or structure of the site, the list being exemplary.
All Products sold through the Site by PIERA are new, delivered in original packaging.
8. Order Placement and Confirmation
Details about registering and confirming an Order can be found in the sections QUICK ORDER and HOW TO BUY , which are an integral part of this document - Terms and Conditions.
Placing an order is done by following these steps:
1. select the desired products and add them to the Shopping Cart, by clicking on the "Add to Cart" button,
2. if you want to add more products to the cart, click on the "Continue shopping" button, if you want to complete the order, click on the "Complete order" button,
3. after selecting the desired products, if you do not have an Account on the Site and do not want to create an Account on the Site, select “Complete order as a Guest” and enter your email address to confirm receipt of the order,
4. enter your billing details,
5. enter the delivery address,
6. delivery is made by courier or by the Romanian Post in areas not covered by courier,
7. choose the payment method,
8. check the "Agree to the Terms and Conditions on the site" field,
9. you have the opportunity to consent to receiving newsletters,
10. Place the order by clicking on the "Complete order" button.
9. Payments
The Buyer is obliged to opt for the payment method chosen before placing the Order, by checking the appropriate option, according to the steps for placing the Order and to make payment for the ordered Products according to the details in the HOW TO PAY section, a document that is an integral part of the Terms and Conditions.
PIERA will issue an invoice to the Buyer for the delivered products. In this regard, the Buyer is obliged to provide the Seller with all the information necessary for issuing the invoice, in accordance with the legislation in force, respectively to complete all the fields marked as mandatory in the order form, otherwise the order cannot be honored. The invoice will be communicated to the Customer in printed material format upon delivery of the ordered products.
Cash payments will comply with the provisions of Law No. 70/2015 for strengthening financial discipline so that the maximum amount that PIERA can collect from an individual is 10,000 lei /day.
The Buyer/User is obliged to pay the value of the Order.
10. Delivery Policy. Transfer of Risk
The products are delivered by PIERA, directly to the Buyer's home or to the address specified by him as the delivery address, on the territory of Romania according to the specifications in the DELIVERY section which is an integral part of this document - Terms and Conditions.
The products are delivered by the seller directly to the Buyer's home / address specified by him.
Transportation is provided through a fast courier company - Urgent Cargus SA and through the Romanian Post, in areas not covered by the courier.
For orders worth less than 200 lei, the delivery cost is 15 RON (VAT included) / parcel and is borne by the Buyer.
We do not charge delivery costs for orders worth a minimum of 200 lei (two hundred lei).
PIERA reserves the right to change the delivery cost at any time, by amending this document. Delivery fees are paid to the Courier together with the value of the purchased products. The costs related to the products and delivery will be mentioned on the customer's invoice.
The order for products in stock will be shipped within 1-5 business days from the order confirmation, via email. The order should reach you within a maximum of 5 business days from the date of order confirmation. This term may be modified by circumstances beyond our control, without exceeding a term of 10 business days, calculated from the date of receipt of your order.
The order will be shipped in packaging that ensures transport security. The responsibility for any damage caused during the transport of the product, parcel or package sent by us lies with the carrier according to the local legislation in force.
Ownership of the Products is transferred from the Seller to the Buyer on the date of payment according to the payment terms.
The Buyer undertakes to sign the delivery document (AWB) presented by the courier upon delivery of the ordered Products.
11. Product conformity guarantee
The products sold through the shop.piera.ro website do not endanger the life, health and safety of consumers.
PIERA products are accompanied by and benefit from the mandatory guarantees provided by the legislation in force.
12. Return Policy
Customers who are not satisfied with the Product may return it and/or choose another product within the value of the returned product, in compliance with the terms and conditions in the DELIVERY section and the RETURN/RETURN POLICY section.
Also, according to the legal provisions in force, Buyers benefit from right of withdrawal of the Contract concluded with PIERA, meaning you have the possibility to return the Products purchased through the Order in compliance with the terms and conditions in the RETURN section.
Products purchased from the shop.piera.ro website can only be returned if they are in the same condition in which they were sent by PIERA, sealed, in the original packaging, have the cardboard label and the original textile label attached, have not been worn and/or washed, and do not show any other signs of use. Worn/washed/used/stained/broken products cannot be returned. For hygiene reasons, "panties" and "slips" items cannot be returned.
Before returning products, Buyers must notify PIERA in advance by completing the return form on the website.
Information regarding the exercise of the right of withdrawal:
1. The Buyer has the right to withdraw from this Contract, without giving reasons, within 14 days.
2. The withdrawal period expires after 14 days, calculated from the date on which the Buyer took physical possession of the Products.
3. To exercise the right of withdrawal, the Buyer must inform the company PIERA SRL, headquartered in Cluj-Napoca, B-dul Muncii, No. 16, building 1, Cluj county, tel: 0040 264 439 822 / 0754354000, fax: 0040 264-406.558, email: eshop@piera.ro, before the expiration of the 14-day period, regarding the decision to withdraw from the contract using one of the following options:
a) by an unequivocal statement stating the decision to withdraw, for example a letter sent by post, fax, email.
b) by completing and submitting the Return Form electronically on the shop.piera.ro Website. If you use this option, we will send you without delay, on a durable medium, for example by e-mail, confirmation of receipt of the withdrawal request;
4. To meet the withdrawal deadline, it is sufficient for you as the Buyer to send the communication regarding the exercise of the right of withdrawal before the expiry of the 14 days.
5. In the event of the Buyer's withdrawal from the Contract, PIERA will reimburse any amount received from you, including the costs of delivery, with the exception of the additional costs resulting from the Buyer's choice of a delivery method other than the cheapest standard delivery type offered by PIERA, without undue delay and, in any event, no later than 14 days from the date on which we are informed of the decision to withdraw from this contract, provided that PIERA receives the returned products within this period.
6. If PIERA does not take possession of the products within 14 days from the date of communication, we may postpone the refund until the date we receive the products back.
7. The refund of the amounts will be made using the same payment method as that used for the initial transaction, unless the Buyer has expressly agreed to another refund method; in any case, PIERA will not charge you any commissions as a result of such a refund.
8. The Buyer must send back the Products without undue delay and in any event not later than 14 days from the date on which the withdrawal is communicated. The deadline is met if the Products are sent back before the expiry of the 14-day period.
9. You as the Buyer will have to bear the direct cost of returning the Products.
10. You, as the Buyer, are responsible for any diminution in the value of the Products resulting from handling other than that necessary to determine the nature, quality and functionality of the Products. The conditions for handling the Products are detailed in the RETURN section.
13. Complaints Resolution Procedure
Any dissatisfaction related to accessing, using, registering on our Site, placing an Order, aspects related to the Order placed and the like, will be communicated to us directly, either by phone at 0754354000, or by email at eshop@piera.ro.
Your dissatisfaction will be recorded and you will receive a written response, to the email address mentioned when you notified us of your dissatisfaction, within a maximum of 3 business days.
The customer declares that he agrees not to make negative advertising, unjustified or unprovable remarks on social networks, media, discussions or in any other way regarding PIERA products, otherwise he will bear the damages caused for the image damage caused to PIERA through these actions.
14. Contractual Liability
By creating and using the Account, the User assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account, being responsible under the law for the activity carried out through his Account.
By accessing the Site, creating the Account, using the Site, placing Orders, etc., the Buyer expressly and unequivocally accepts the Terms and Conditions in the latest version available on the Site.
After creating the Account, use of the content is equivalent to acceptance of the changes made to the Site Terms and Conditions and/or updated versions of the Terms and Conditions.
The Buyer/User is responsible for checking the current version of the Terms and Conditions whenever they use the Site.
Acceptance of the Site's Terms and Conditions is confirmed by checking the corresponding checkbox on the Site and/or by sending the Order and/or by making an online payment.
We do not assume liability for damages of any kind that the Buyer or any other third party may suffer as a result of our performance of any of our obligations under the Order, nor for damages that may result from the use of the Goods after delivery, let alone for their loss.
All risks related to the use of the Site are borne by visitors/Buyers/Users. PIERA does not guarantee that the Site, the servers on which it is hosted or the e-mails sent are free of viruses or other potentially harmful computer components, that it does not contain errors, omissions, malfunctions, etc. PIERA is not responsible for any damage to your computer/other equipment, nor for viruses that may infect your computer or other equipment, arising from the use, access or browsing of our Site or from your downloading of any content, information, materials, data, texts, images, video or audio from the Site. This clause does not affect the rights of consumers established by the legislation in force.
15. Information and Communications
Subscribing and unsubscribing to the PIERA newsletter is free and voluntary and implies acceptance of the following terms of use. Messages sent by PIERA following subscription cannot be considered unsolicited, and you have the right and possibility to unsubscribe at any time by following the instructions in the footer of each e-mail received. The messages sent comply with the Electronic Commerce Law regarding commercial communication, as stipulated by Romanian and international legislation.
If information, materials, documents are sent to us, by any possible method including e-mail, mail, fax, online forms, the sender thereof unequivocally grants PIERA the unlimited, free, irrevocable right to use, reproduce, modify, adapt, distribute and present this information by any means.
16. Advertising
When creating an Account on the site and/or placing an Order, the Buyer has the opportunity to consent to receiving Newsletters, as defined at the beginning of this document.
By checking the corresponding checkbox on the Site, the Buyer/User expresses their express prior consent to receive commercial communications, including Newsletters.
17. Changes to the Terms and Conditions
PIERA reserves the right to make changes at any time to the content of the shop.piera.ro Site, the policy, the terms and conditions of use, the terms and conditions of sale, without the need for prior notification to Buyers/Users/visitors in this regard, although we will be careful to notify you of these changes.
Any changes to the Terms and Conditions will only be effective for new orders placed after the respective changes are published on this site.
Users/Buyers/visitors of the shop.piera.ro Site are required to regularly check the terms and conditions of use. If you do not agree with the changes made to the Terms and Conditions by PIERA, you are requested to stop using the Site. If you continue to use the Site, this represents your express agreement to the changes made.
18. Force Majeure
Neither of the contracting parties is liable for the failure to perform on time or/and for the improper performance - in whole or in part - of any obligation incumbent upon it under the concluded contract, if the failure to perform or improper performance of the respective obligation was caused by force majeure, as defined by law, namely any external, unforeseeable, absolutely invincible and inevitable event.
The party invoking force majeure is obliged to notify the other party, within 5 (five) days, of the occurrence of the event, as well as its cessation and to take all possible measures to limit its consequences. If the notification is not sent within the deadline, the party invoking the occurrence of the force majeure event will be liable for all damages caused as a result of the omission of notification regarding the occurrence/cessation of the force majeure case.
If the force majeure event lasts more than 30 (thirty) days, either party will have the right to notify the other party of the full termination of the Contract, without either party being able to claim damages from the other.
19. Applicable Law
The legal relationship between the parties, including the use of the Site, the placement of Orders, the conclusion, execution and termination of the Contract shall be governed and interpreted in accordance with Romanian law. Any disagreement between the Seller and the Buyer shall be resolved amicably, and in case of failure, shall be submitted to the competent courts of Romania.
20. Final Provisions
The website shop.piera.ro is owned by PIERA, which grants you the right to access and use the Website subject to your acceptance of these Terms and Conditions. By accessing and using the Website, you automatically and unequivocally agree to comply with the Terms and Conditions on the Website.
PIERA has the right to modify the Terms and Conditions at any time, without prior notice, by posting the updated version on the site, and the Buyer/User is obliged to check and read the Terms and Conditions whenever they access the Site. The Buyer/User is obliged to strictly comply with the Terms and Conditions on the Site and cannot invoke ignorance of the Terms and Conditions on the Site, including the annexes, the document valid at the date of accessing, using and/or placing an Order on the Site.
PIERA periodically organizes various promotions that are announced on the Site. These are subject to special regulations approved by PIERA in each case and published on the Site on the date of the start of the promotion. The promotions begin their validity at the moment of their activation on the Site and cease their validity at the moment of their inactivation on the Site. The promotions cannot be combined with each other or with other discounts and are valid only within the limit of stock.
If any of the provisions contained in the Terms and Conditions is null and void or becomes inoperative, this will not affect the validity of the other clauses. The provisions of the Terms and Conditions are supplemented by the provisions of the Civil Code as well as the provisions of the applicable legislation in force.
