PRIVACY POLICY
ON THE PROTECTION OF PERSONAL DATA

As of 25 May 2018, Regulation 2016/679/EU on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as the "Regulation") will be applied by all Member States of the European Union. The aim of this Regulation is to create a single and uniform legislative framework across the European Union, eliminating the need for national implementing measures.
This website is exclusively intended for users over the age of 16.
The company PIERA SRL, with the data below, is responsible for operating the website www.shop.piera.ro and has the status of operator.
In order to comply with our obligations arising from the Regulation, and given that the protection of your data is a major and constant concern for us, we have developed this document, which establishes the categories of personal data that we collect when you visit our website, the purpose and basis of the processing, the duration of the processing, where we store and to whom we transmit this data, as well as the rights you have as a data subject, implemented specifically to ensure the protection of your fundamental rights and freedoms and in particular their right to the protection of personal data.

a) " personal data " means any information relating to an identified or identifiable natural person ("data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to his or her physical, physiological, genetic, mental, economic, cultural or social identity.
b) " processing " means any operation or set of operations which is performed upon personal data or upon sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
(c) " controller " means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of the processing are determined by Union or national law, the controller or the specific criteria for his designation may be laid down in Union or national law;
d) " processor " means the natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.
2. WHO IS THE PERSONAL DATA CONTROLLER?
PIERA SRL ("PIERA"), a Romanian legal entity, organized and operating in accordance with the laws of Romania as a limited liability company, is responsible for operating the website www.shop.piera.ro, and is the controller of the personal data you transmit to us.

We assure you that your personal data is processed lawfully, fairly and transparently, only for the explicit purposes that have been made known to you.
PIERA, as the controller, processes data in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, by taking appropriate technical or organizational measures.
3. WHAT IS PERSONAL DATA? WHAT DATA DO WE COLLECT?
We collect from you only those personal data that we need to be able to provide you with the possibility of using our website, to be able to fulfill your orders and to be able to provide you with access to our products and to be able to keep you informed about our products, services and offers (direct marketing), to the extent that this is permitted by legal regulations or is done on the basis of your consent.
PIERA collects personal data in two important ways:
1. The information you provide us directly , through the forms available on the website www.shop.piera.ro, as follows:

- email address and phone number,
- billing address (home address), delivery address,
- bank account number;
- IP
- additional information that you voluntarily decide to communicate to us.
2. Information we obtain when you use our website , for example:
- we process the history of your interactions with our newsletters,
- PIERA product purchase history,
- telephone conversations/email correspondence related to orders placed,
We emphasize that we do not collect or process data from minors, our products are not offered directly to a child.
Each category of data will be collected for specified, explicit and legitimate purposes and will not be further processed in a manner incompatible with those purposes and will be kept for a period not exceeding the period necessary to achieve the purposes for which they are processed.
In order to ensure the principle of transparency of information when processing your personal data, we inform you below about how we process your data, the purposes and the legal basis (legal basis) of the activities through which we process your data.
4. PURPOSES AND LEGAL BASIS OF THE PROCESSING OF PERSONAL DATA
PIERA will process personal data on the following grounds:
a) Concluding or executing the contract concluded with you and to respond to your requests. For example, to register the order, to deliver the products, to collect the value of the products sold, to refund the value of some products.
b) PIERA's legitimate business interests , for example, fraud prevention, maintaining site security, direct marketing and improving our products, without thereby affecting your fundamental rights and freedoms.
c) Fulfillment of a legal obligation of PIERA , i.e. an obligation resulting from a law, such as accounting and tax obligations, which are strictly regulated (for example, the data that invoices must contain, document retention periods, filing of declarations), procedures.
d) The consent you expressly grant when We do not rely on any other legal basis for the processing of your data. Consent can be withdrawn at any time.
4.1. CREATING A USER ACCOUNT
When you create a user account on our website www.shop.piera.ro, we request and collect your name, surname, address, telephone number and email address, IP.
We need this personal data for pre-contractual purposes, namely to be able to place an order, the basis for processing being the contractual obligation. To the extent that you do not agree to the processing of your data, PIERA will not be able to honor and deliver your orders.
Your data processed at the time of account creation is not subject to a decision based solely on automated processing, including profiling, will not be disclosed to any third party and will not be subject to a transfer to a third country or an international organization.
4.2.PLACEMENT OF AN ORDER. CANCELLATION OF THE ORDER
When completing and finalizing the order form, we request and collect from you your first name, last name, contact address, delivery address, phone number, email address, and IP address.
This personal data is necessary for contractual purposes, in order to fulfill your orders, deliver the products to the indicated address, issue the invoice, fulfill our warranty obligations associated with the products, or, as the case may be, to return the products.
The basis for the processing is the contractual obligation between the parties as established by the Terms and Conditions. To the extent that you do not agree to the processing of your data, PIERA will not be able to fulfill and deliver your orders.
At the same time, your personal data is necessary for us to complete and deliver tax invoices related to the delivered products, respectively for the purpose of fulfilling PIERA's legal obligations, such as accounting and tax obligations.
Your online payment data will not be accessible or stored by PIERA, but only by the electronic payment service provider or another entity authorized to provide card identification data storage services, of whose identity you will be informed, prior to the actual entry of the card details you use for online payment. The only data regarding the payment made that we will store are those related to the date of initiation and completion of the transaction as well as the payment status. Based on the legal obligation, your personal data necessary for the preparation of payment documents will be provided to our contractual partners who provide us with IT and accounting services and will be used for the purpose of submitting tax and accounting declarations to the tax authorities.
When canceling an order, by completing and submitting the return form, we request and collect from you your last name, first name, return address, phone number, email address, account and bank number, invoice number in order to fulfill the legal obligation to return the amount paid for the order you canceled or for the delivery of new products.
Your personal data will be retained for the entire duration of the contractual relationship as well as for the duration provided by the legal regulations in force regarding the obligation to archive financial and accounting documents from the date of placing the last order.
In order to be able to execute our obligations on time and in accordance with the contract, your personal data will be disclosed to our carefully selected, trusted contractual partners:
• the provider of the data storage service on external servers located in Romania;
• the accounting services provider;
• the provider of communications and e-mail correspondence transmission services;
• companies involved in the operation of our website;
• the mobile phone service provider that helps us keep in touch with you, located in Romania;
• couriers with whom we have a contractual relationship and the Romanian Post;
• online payment service processors;
• other parties: public authorities and institutions, accountants, auditors, lawyers and other external consultants, whose activity implies the need to know this data or where the law obliges us to make this disclosure.
Your data processed at the time of account creation is not subject to a decision based solely on automated processing, including profiling, and will not be subject to a transfer to a third country or an international organization.
4.3. NEWSLETTER – DIRECT MARKETING
Subscribing and unsubscribing to the PIERA newsletter is free and voluntary. and is done exclusively based on your consent . The Newsletter is a means of periodic, exclusively electronic (e-mail) information on the Seller's Goods, Services, Promotions, etc. during a certain period, without any commitment from the Seller with reference to the information contained therein.
In order to provide marketing services, we collect your email address. This data will be used exclusively to keep you informed about our products, services and offers. The basis for the processing of personal data is your consent, the duration of the processing being the entire duration of the existence of the consent.
Consent can be withdrawn at any time. by an email sent to the email address eshop@piera.ro or gdpr@piera.ro or by accessing the unsubscribe link in the email received from us and will result in the cessation of processing. The withdrawal of consent will not affect the lawfulness of the processing carried out before its withdrawal.
Your data will not be transferred to any other operator or processor and will not be transmitted to any third country or international organization.
4.4.COOKIES
The website www.shop.piera.ro uses cookies, which are data stored on the user's hard drive, containing information about them. The use of the cookie mechanism is an advantage for visitors, as it allows the memorization of site navigation options such as the language in which the site is displayed, the type of filters that are applied when displaying certain pages, and the memorization of the username and password for quick access to the site's content. The content of the plugins will be transmitted by the respective provider directly to your browser and will be integrated by it into the website. 6. SECURITY OF YOUR PERSONAL DATA
The security of your personal data is a priority for us. We assure you that any data processing is carried out in compliance with the principles guaranteed by the Regulation and processed in a manner that ensures adequate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, by taking appropriate technical or organizational measures, by implementing appropriate internal data protection policies.
This site adopts all necessary security measures to protect the personal information of our users. When filling in personal data on our site, the information will be protected both offline and online. 7. WHAT RIGHTS DO YOU HAVE?
According to the Regulation, as a person concerned by the processing of your personal data, you are ensured the protection of your fundamental rights and freedoms.
Furthermore, PIERA, as the controller, ensures the respect of your rights, recognized by the Regulation. In order to guarantee the protection of your personal data, you have the following rights:
7.1. Right of access to your data. (according to art. 15 of the Regulation) – you can request that we communicate to you the categories of personal data that we process, the purpose for which the processing takes place, the recipients to whom they have been or will be communicated, the period for which they are expected to be stored or, if this is not possible, the criteria used to determine this period; the existence of an automated decision-making process including the creation of profiles.
7.2. Right to rectification of data (according to art. 16 of the Regulation) - in the event that there are errors regarding the data that are processed about you, you have the possibility to request their correction or completion. PIERA will communicate the rectification to each recipient to whom the data was transmitted, unless this proves impossible or involves disproportionate efforts.
7.3. Right to data deletion ("right to be forgotten") (according to art. 17 of the Regulation) - you can request and obtain from PIERA the deletion of your processed data, if the data is no longer necessary for the purposes for which they were collected or processed, if you have withdrawn your consent on the basis of which the processing took place and there is no other legal basis for the processing; if you object to the processing and there are no overriding legitimate reasons for the processing; the personal data have been processed unlawfully; the personal data must be deleted for compliance with a legal obligation to which PIERA is subject under Union law or Romanian law; the personal data have been collected in connection with the provision of information society services.
7.4. Right to restriction of data processing (according to art. 18 of the Regulation) - you have the right to request restriction of the processing of your data in the following situations: if you contest the accuracy of the data, for a period that allows us to verify the accuracy of the data; if the processing is unlawful and you oppose the deletion of personal data, requesting instead the restriction of their use; if PIERA no longer needs the personal data for the purpose of processing, but you request them for the establishment, exercise or defense of a right in court; if you have opposed the processing (you have exercised your right to object) for the period of time during which it is verified whether the legitimate rights of PIERA prevail over your rights.
7.5. Right to data portability or transfer (according to art. 20 of the Regulation) – you have the right to receive the personal data you have provided to PIERA (which processes them under a contract or based on your consent or by automated means) in a structured, commonly used and machine-readable format and you have the right to transmit these data to another operator, without hindrance from PIERA.
7.6. Right to object (according to art. 21 of the Regulation) - you have the right to object at any time to the processing of your data for direct marketing purposes, including the creation of profiles, and in this case your data will no longer be processed for this purpose. In this regard, you can unsubscribe from the newsletter and other information by sending an email to the email address eshop@piera.ro or gdpr@piera.ro or by accessing the unsubscribe link in the email received from us.
7.7. The right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the data subject or similarly significantly affects him/her. (according to art. 22 of the Regulation)
All the aforementioned rights can be exercised through a simple request addressed to PIERA, as the operator, at our headquarters or at the email address gdpr@piera.ro or by accessing the functions made available on our website.
You will receive the response and information on the actions taken by PIERA following your request without undue delay and, in any case, no later than 1 (one) month from receipt of the request. This period may be extended by 2 (two) months when necessary, taking into account the complexity and number of applications, with you being informed of any such extension within 1 (one) month of receipt of the application, also providing you with the reasons for the delay.
In addition, you have the right to file a complaint (according to art. 77 of the Regulation) to the National Supervisory Authority for Personal Data Processing.
